Thank you for using FoundDocument services, here after referred to as Service.

We offer you our services based on your agreement to our terms of service and privacy policies. By using the services, you therefore agree to be bound by these terms. We kindly request you to read them carefully.

Using our services

As a user of FoundDocument, you must follow any policies made available to you within the Services.

Do not misuse our Services, for example, do not try to access any of our service using a method or interface other than the interface and the instructions that we provide. You may use our Services only as permitted by law, including applicable export and control laws and regulations. We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct.

Using our Services does not give you ownership of any intellectual property rights in our Services or the content that you access. You may not use content from our Services unless you obtain permission from its owner or are otherwise permitted by law. These terms do not grant you the right to use any branding or logos used in our Services. Do not remove, obscure or alter any legal notices displayed in or along with our Services.

Our Services display some content that is not FoundDocument's. This content is the sole responsibility of the entity that makes it available. We may review content to determine whether it is illegal or violates our policies, and we may remove or refuse to display content that we reasonably believe violates our policies or the law. But that does not necessarily mean that we review content, so please do not assume that we do.

In connection with your use of the Services, we may send you service announcements, administrative messages and other information. We also wish to let you know that you may opt out of some of those communications.

Some of our Services are available on mobile devices. Do not use such Services in a way that distracts you and prevents you from obeying traffic, other people's privacy or safety laws.

Your FoundDocument Account

You may need a FoundDocument Account in order to use some of our Services. You may create your own FoundDocument Account, or the Account may be assigned to you by an administrator, such as your employer. If you are using a FoundDocument Account assigned to you by an administrator, different or additional terms may apply, and your administrator may be able to access or disable your account.

To protect your FoundDocument Account, keep your password confidential. You are responsible for the activity that happens on or through your Account. Try not to reuse your FoundDocument Account password on third-party applications. If you learn of any unauthorized use of your password or FoundDocument Account, notify us.

Privacy and Copyright Protection

FoundDocument's Privacy Policies explain how we treat your personal data and protect your privacy when you use our Services. By using our Services, you agree that we can use such data in accordance with our Privacy Policies.

We respond to notices of alleged copyright infringement and terminate accounts of repeat infringers.

We provide information to help copyright holders manage their intellectual property online. If you think that somebody is violating your copyright and want to notify us, you can find information about submitting notices and FoundDocument's policy about responding to notices in our Help Centre.

Your Content in our Services

You are responsible for your use of the Services and for any Content you provide, including compliance with applicable laws, rules, and regulations. Our Services allow you to upload, submit, store, or receive content. You retain ownership of any intellectual property rights that you hold in that content. In short, what belongs to you stays yours.

When you upload, submit, store, or receive content to or through our Services, you give FoundDocument (and those we work with) a worldwide license to use, host, store, reproduce, modify, create derivative works (such as those resulting from translations, adaptations or other changes that we make so that your content works better with our Services), communicate, publish, publicly perform, publicly display and distribute such content. The rights that you grant in this license are for the limited purpose of operating, promoting and improving our Services, and to develop new ones. This license continues even if you stop using our Services (for example, for a document type that you have added to our list). Some Services may offer you ways to access and remove content that has been provided to that Service.

Our automated systems analyses your content (including your feedback) to provide you with personally relevant product features, such as tailored advertising and service provider recommendations. This analysis occurs as the content is sent, received and when it is stored.

If you have a FoundDocument Account, we may display your Profile name, Profile photo and actions you take on FoundDocument or on third-party applications connected to your FoundDocument Account (such as twitter) in our Services, including displaying in ads and other commercial contexts. We will respect the choices you make to limit sharing or visibility settings in your FoundDocument Account. For example, you can choose your settings so that your name and photo do not appear in an ad.

If you submit feedback or suggestions about our Services, we may use your feedback or suggestions without obligation to you.

We also reserve the right to remove Content that violates the User Agreement, including for example, impersonation, unlawful conduct, or harassment. Information regarding specific policies and the process for reporting or appealing violations can be found in our Help Center.

About Software in our Services

When a Service requires or includes downloadable software, this software may be updated automatically on your device once a new version or feature is available. Some Services may let you adjust your automatic update settings.

License to use the Services

FoundDocument gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the Software provided to you by FoundDocument as part of the Services. This license is for the sole purpose of enabling you to use and enjoy the benefit of the Services as provided by FoundDocument in the manner permitted by these terms.

The Services are protected by copyright, trademark, and other laws of both the Kenya and foreign countries. Nothing in the Terms gives you a right to use the FoundDocument name or any of the FoundDocument trademarks, logos, domain names, and other distinctive brand features. All right, title, and interest in and to the Services (excluding Content provided by users) are and will remain the exclusive property of FoundDocument and its licensors.

You may not copy, modify, distribute, sell or lease any part of our Services or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.

Modifying and Terminating our Services

We are constantly changing and improving our Services. We may add or remove functionalities or features and we may suspend or stop a Service altogether.

You can stop using our Services at any time, even though we would be sorry to see you go. FoundDocument may also stop providing Services to you or add or create new limits to our Services at any time.

Our Disclaimers

We provide our Services using a commercially reasonable level of skill and care and we hope that you will enjoy using them. But there are certain things that we do not promise about our Services.

OTHER THAN AS EXPRESSLY SET OUT IN THESE TERMS OR ADDITIONAL TERMS, NEITHER FOUNDDOCUMENT NOR ITS SUPPLIERS OR DISTRIBUTORS TAKE OWNERSHIP OR STORE PHYSICAL PROPERTY THAT IS REPORTED THROUGH FOUNDDOCUMENT WE ONLY AID REPORTING AND INFORMING OWNERS OF DOCUMENTS WHERE THEY COULD PROBABLY BE AS REPORTED THROUGH OUR SYSTEM.

Liability for our Services

WHEN PERMITTED BY LAW, FOUNDDOCUMENT AND DISTRIBUTORS WILL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES OR DATA, FINANCIAL LOSSES OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES.

TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF FOUNDDOCUMENT AND ITS AND DISTRIBUTORS FOR ANY CLAIMS UNDER THESE TERMS, INCLUDING FOR ANY IMPLIED WARRANTIES, IS LIMITED TO THE AMOUNT THAT YOU PAID US TO USE THE SERVICES (OR, IF WE CHOOSE, TO SUPPLYING YOU WITH THE SERVICES AGAIN).

IN ALL CASES, FOUNDDOCUMENT AND ITS AND DISTRIBUTORS WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT IS NOT REASONABLY FORESEEABLE.

Business uses of our Services

If you are using our Services on behalf of a business, that business accepts these terms. It will hold harmless and indemnify FoundDocument and its affiliates, officers, agents and employees from any claim, action or proceedings arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, judgements, litigation costs and legal fees.

Ending These Terms

You may end your legal agreement with FoundDocument at any time by deactivating your account(s) and discontinuing your use of the Services.

We may suspend or terminate your account or cease providing you with all or part of the Services at any time for any or no reason, including, but not limited to, if we reasonably believe: (i) you have violated these Terms or the FoundDocument Rules, (ii) you create risk or possible legal exposure for us; (iii) your account should be removed due to unlawful conduct, (iv) your account should be removed due to prolonged inactivity; or (v) our provision of the Services to you is no longer commercially viable. We will make reasonable efforts to notify you by the email address associated with your account or the next time you attempt to access your account, depending on the circumstances. In all such cases, the Terms shall terminate, including, without limitation, your license to use the Services, except that the following sections shall continue to apply: Privacy, Content in the Service, Limitations and Liability, and About our Terms.

About Our Terms

We may revise these Terms from time to time. The changes will not be retroactive, and the most current version of the Terms, will govern our relationship with you. Other than for changes addressing new functions or made for legal reasons, we will notify you 30 days in advance of making effective changes to these Terms that impact the rights or obligations of any party to these Terms, for example via a service notification or an email to the email associated with your account. By continuing to access or use the Services after those revisions become effective, you agree to be bound by the revised Terms.

In the event that any provision of these Terms is held to be invalid or unenforceable, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect. FoundDocument's failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

These Terms are an agreement between you and FoundDocument.

Who May Use Our Services?

You may use the Services only if you agree to form a binding contract with FoundDocument and are not a person barred from receiving services under the laws of the applicable jurisdiction and you must be at least 13 years old. If you are accepting these Terms and using the Services on behalf of a company, organization, government, or other legal entity, you represent and warrant that you are authorized to do so and have the authority to bind such entity to these Terms, in which case the words “you” and “your” as used in these Terms shall refer to such entity.

You do not have to create an account to use some of our service features such as viewing advertisements, reporting a found document or a lost document, and reading about our company and services. However, there are services which are only availed upon registration with us and providing your information.

Information FoundDocument collects

When you choose to create an account to access privilege service on FoundDocument, you must provide us with some personal data. The personal data is used to provide I used to provide our services. This personal data we collect includes; a name, a password, an email address, phone number, gender date of birth, employment status, nationality. The information you provide shall only be used to server you better and to allow for your identification when you are accessing our services.

We also collect information when you use our service and the information you may provide are on the document you may have found or lost. The information of the document includes, type of document, country on the document, serial/document number, place or location it was lost or found including GPS coordinates where application. This information can be provided at the point of loss or when the document is found. Additionally, as a subscriber, you can same the information stated above in your account so as to report when your document is lost.

We collect information about the browsers and devices that you use to access FoundDocument services, which helps us provide features such as responsiveness of the website to your device and browser. The information that we collect includes unique identifiers, browser type and settings, device type and settings, operating system, mobile network information including operator name and phone number and application version number. We also collect information about the interaction of your FoundDocument App, browsers, IP address, crash reports, and the date, time and referrer URL of your request.
